Dr. Swain is Co-founder, Vice President and Managing Director of Dispute Dynamics, Inc. She received her Bachelor of Science degree from the University of Pittsburgh, graduating Magna Cum Laude. After college, she attended a joint graduate program in law and psychology, receiving her Juris Doctor from Villanova Law School and her Doctorate in Clinical Psychology from Hahnemann University in Philadelphia, PA.
Dr. Swain has been a litigation consultant since 1988. She has worked in federal and state venues throughout the United States, and in Puerto Rico. Dr. Swain has been involved in over 1,000 cases in areas which include Antitrust, Consumer Class Action, Contract, Employment, Environmental, Fraud, Intellectual Property, Personal Injury, Products Liability, Professional Malpractice, RICO, Securities, and Toxic Torts.
Dr. Swain's experience includes case evaluation and consultation, jury research, trial strategy assessment, venue analysis, witness preparation, jury selection, trial monitoring, and juror interviews. Over the span of her career, Dr. Swain has been involved in over 450 jury selections and 500 witness preparation sessions.
Additionally, she has provided assistance with complex matters set for mediation and arbitration. Dr. Swain has managed trial consulting teams in numerous high profile, complex cases. She has worked for and against many of the best trial lawyers in the United States.
Dr. Swain has written about and has given educational seminars on a wide variety of topics, including jury selection, opening statements, experts, witness preparation, damage presentations, direct and cross-examination techniques, jury psychology, and research methodology. She has spoken at various ABA Annual Meetings for the Antitrust and Labor & Employment Sections, The Antitrust Annual Spring Meeting, California State Bar Annual Golden State Antitrust and Trade Regulation Law Institute, California CPA Society Litigation Advanced Forum, Association of Southern California Counsel Annual Seminar, various State Bar functions, and various Inns of Court. Dr. Swain has recently authored a book chapter concerning how jurors perceive econometricians, and how econometricians can increase the effectiveness of their testimony.
Although she does not engage in the practice of law, Dr. Swain is a member of the Pennsylvania Bar and the American Bar Association.
